Are employees required to give notice if they resign during their probationary period?

The probationary period in the United Arab Emirates (UAE) is a crucial phase for both the employer and the employee, allowing each to assess their professional compatibility before committing to a long-term arrangement. However, it is essential to understand the legal obligations regarding notice periods and the potential consequences of resigning during this period.

Notice period required in the event of resignation during the probationary period

According to the’Article 9(3) of Federal Decree-Law No. 33 of 2021 Under the legislation governing employment relations in the UAE, an employee wishing to resign during their probationary period in order to join another employer within the UAE must give their current employer written notice at least a month before the desired termination date. Furthermore, unless otherwise agreed, the new employer is obliged to reimburse the original employer for any recruitment costs or contractual fees incurred.

If the employee is considering leaving the UAE, written notice of 14 days is required. However, if the employee returns to the UAE and obtains a new work permit within three months of their departure, the new employer must reimburse the previous employer for recruitment costs, unless otherwise agreed between the parties.

Validity of the non-competition clause during the probationary period

The non-competition clause is intended to prevent an employee from joining a rival company for a certain period after their contract has ended. However, the’Article 12(5)(b) of Cabinet Resolution No. 1 of 2022 stipulates that the employee is exempt from this clause if the contract is terminated during the probationary period. Thus, in the event of resignation during this period, the employee may, in principle, join a competing company without being bound by the non-competition clause.
